How to get a court order in Uganda

You can get a court order for the motor vehicle change of ownership in Uganda by submitting all required details to the Magistrates court of choice. When processing an absentee transfer of a Motor vehicle through the Ministry of Works and Transport (MoWT), an order is mandatory in addition to the affidavit.

What is a Court order?

A Court order may refer to a “directive” or “instruction” by the Courts of Law to an individual, company, organization, etc to do anything. The court rules out in favor of anyone and gives instructions to anyone to do something.

Why Make An Court During Transfer?

A court order is required as it gives the licensing authority (MoWT) powers to process the vehicle transfer to the new owner in absence of the current registered owner. Court makes an order in favor of the claimant for as long as all supporting documents as proof of ownership are presented to court.

Requirements for Court order

  • Original/certified Newspaper advert
  • Police report in case of lost logbook
  • Original vehicle logbook
  • Copies of National ID card
  • Search and certification report for lost logbook
  • Motor vehicle Inspection report

Depending on why one is processing a court order for transfer of names for motor vehicle when current registered owner is missing, you will be required to attach relevant documents like a national ID photocopy, copy of the logbook, purchase agreement, proof of ownership, etc as you will be requested.

How to process a Court order

Attach all of the supporting and required documents and proceed to court. You will be attended to, an affidavit in support of motion requested and you order will be processed once what you have satisfied the judge sitting at the Magistrates Court at Nakawa, Buganda road, Kakiri, Mengo, LDC, etc will issue the order.

An example of transfer, the above will require one to provide proof of ownership of the said anything as indicated in the requirements above.

How much is Court Order in Uganda?

The cost of a court order in Uganda varies depending on where you process the document from, and who does the work for you. You may be charged anywhere between 50,000/= to 150,000/= Uganda shillings or even more than that depending on the purpose. And when you use a broker, the charges can go up to 200,000/= shillings.

What next after the court order is issued?

Once you have gone through all the steps and an order is issued, you should then submit the documents to Nakawa MoWT office for processing.

Final Word

Issues to do with court orders can be processed well once has all of the requirements have been met. The process takes a few hours to a few days to be completed depending on where you go, and the availability of the Judge to make it. For motor vehicle transfers, the court order must be attached to the statutory declaration before submitting the documents to MoWT office Nakawa.
